These terms and conditions (“Terms”) govern the sale of artworks (“Artwork”) by Art Parks International ltd (“Seller”, “we”, “us”, “our”) to you, the purchaser (“Buyer”, “you”). By placing an order for Artwork through this website, you agree to be bound by these Terms.
Artwork Description and Authenticity
We endeavour to describe and display the Artwork as accurately as possible. However, With the individual nature of the work, we cannot guarantee that the image representation or description of the Artwork will be entirely accurate, complete, reliable, or error-free.
The popularity of the sculpture on the site sometimes means that an advertised piece of work has just been bought. This being the case you will be notified by the Artist or ourselves with an estimated best casting, fabrication or carving time. As you would expect this will depend on factors beyond anybody’s control, such as the pressure of work on the foundries and studios which varies at different times of the season. You can rest assured that because of ArtParkS standing in the artworld you will get the best possible priority.
A certificate of authenticity is provided with each Artwork purchased on ArtParkS being informed that the Artwork has arrived safely.
Purchase and Payment
By completing the purchase process and placing an order, you are making an offer to purchase the Artwork subject to these Terms.
Payment must be made in full before the Artwork will be commissioned, created or dispatched.
Shipping and Delivery
We’re pleased to offer complimentary standard shipping to our customers. This service is a part of our commitment to make your art buying experience as smooth and enjoyable as possible.
If you require expedited or special delivery services, additional charges will apply. We’re here to assist with any specific shipping needs, ensuring your art arrives safely and promptly. Please note, these bespoke services will involve extra organisation and costs.
By choosing special shipping services, you agree to any additional costs and arrangements required. We promise transparent communication of these charges, which will proceed only with your consent.
Estimated delivery times are to be used as a guide only and commence from the date of dispatch.
International Taxes and Tariffs Customers ordering for delivery to countries outside of our base may be subject to import duties, taxes, and tariffs imposed by the destination country. These charges are beyond our control and must be borne by the recipient. ArtParkS.co.uk is not responsible for any additional charges incurred for customs clearance, and we have no influence over these fees nor can we predict what they may be. It is your responsibility to ensure compliance with your local customs laws and to bear any additional costs. We recommend contacting your local customs office for further information before placing your order.
Cancellations, Returns, and Refunds
You may cancel your order within 14 days after placing it, provided the Artwork has not already been made or dispatched.
We accept returns within 2 days of receipt, provided the Artwork is in its original condition and packaging.
Refunds will be processed within 2 days of the returned of the Artwork.
Intellectual Property Rights
All intellectual property rights in the Artworks are owned by the creators of the Artworks. Upon sale, ownership of the physical Artwork is transferred to you, but any intellectual property rights remain with the original creator.
Privacy
We will process your personal data in accordance with our Privacy Policy, which forms part of these Terms.
Limitation of Liability
Our liability for losses you suffer as a result of us breaking these Terms is strictly limited to the purchase price of the Artwork you purchased on condition that the Artwork has been returned in the condition mentioned in point 2.
Changes to Terms
We reserve the right to make changes to these Terms at any time. Your continued use of this website following such changes will indicate your acceptance of the new Terms.
Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of the jurisdiction in which we are based, and any disputes are to be resolved exclusively in the courts of that jurisdiction.
